Welcome to C-13 Digest, a platform aimed at licensed fence contractors in California. By accessing our site, registering an account, or purchasing a subscription, you agree to be bound by the following Terms of Service. Please read them carefully.

 

1. Eligibility and Privacy

  • Age Requirement: You must be at least 18 years old to create an account, purchase a subscription, or use this platform.
  • Licensure Representation: If you register for a "Contractor Subscription" (Tier 2), you represent and warrant that you hold a valid, active contractor's license in the State of California.
  • Privacy Policy: Your use of C-13 Digest is also governed by our Privacy Policy, which explains how we collect, use, and protect your data (including any applicable disclosures under the California Consumer Privacy Act / CCPA). By using our site, you consent to our data practices.

 

2. Subscription Rules, Auto-Renewal, and Cancellation

We offer four distinct paid subscription tiers that operate on a yearly recurring billing schedule.

  • Tier 1 (Individual Subscription): Costs $20.00 per year.
  • Tier 2 (Contractor Subscription): Costs $200.00 per year.
  • Tier 3 (Basic Vendor Subscription): Costs $1,800.00 per year.
  • Tier 4 (Premium Vendor Subscription): Costs $10,000.00 per year.

Automatic Renewal: All payments and recurring auto-renewals are processed securely through Stripe. By purchasing a subscription, you agree to automatic yearly billing. Your payment method on file will be charged automatically on the anniversary of your initial sign-up date. We will send you a reminder email prior to your renewal date as required by California law.

Cancellation: You may cancel your auto-renewal at any time through your account dashboard or by contacting us directly. Cancellations must be made before the renewal date to avoid being charged for the next year. If you cancel, you will retain access to your subscription tier features until the end of your current paid billing cycle. No prorated refunds are provided for mid-year cancellations. Once a subscription lapses or is canceled and the billing cycle ends, you will automatically lose the associated role and site permissions.

 

3. Content Access and Permissions

Specific site features are strictly governed by your active subscription tier:

  • Articles and News: Unregistered visitors can view article headlines and summaries only. Tier 1, Tier 2, Tier 3, and Tier 4 subscribers are granted full access to read the complete text of all articles. Tier 4 Premium Vendor subscribers are granted the unique permission to author and publish up to 12 Sponsored Articles per year.
  • Business Listings: All users, including unregistered visitors, can view business listings and read existing reviews. Tier 3 and Tier 4 subscribers have the permission to edit their own business listings. Only Tier 2 Contractor subscribers are granted the permission to post reviews or comments on business listing nodes.
  • Classified Ads: Unregistered users can only read classified ad titles. Tier 1, Tier 2, Tier 3, and Tier 4 subscribers can read the full text of all classified ads and respond to them. Tier 1 subscribers may post "Resume" ads. Tier 2, Tier 3, and Tier 4 subscribers may post all types of ads.

 

4. User Conduct, Suspension, and Termination

Users are strictly prohibited from engaging in illegal, offensive, harassing, defamatory, or fraudulent activity. You may not use the site to distribute malware, scrape data, or infringe on the rights of others.

  • Ad Communications: Responses to classified ads are sent directly via email to the ad poster without any site moderation or approval step. Subscribers are provided the ability to block each other to prevent unwanted direct messaging.
  • Enforcement: C-13 Digest reserves the right to suspend or terminate your account and revoke access to the site immediately, without prior notice or refund, if we determine you have violated these Terms of Service.
  • Content Deletion Upon Termination: If your account is terminated due to a violation of these Terms or at your own request, any user-generated content you have submitted—including sponsored articles, business listings, reviews, and classified ads—will be permanently deleted from the platform.

 

5. Intellectual Property and DMCA

C-13 Digest retains all ownership rights to the platform's original content, branding, code, and design. You retain full ownership rights to your own submitted content. By submitting content, you grant C-13 Digest a worldwide, non-exclusive, royalty-free license to display, format, and distribute your content across the platform.

Copyright Infringement (DMCA): We respect the intellectual property of others. If you believe your copyrighted work has been infringed upon by user-generated content on our site, please send a written notice to our designated Copyright Agent containing a description of the work, where it is located on the site, your contact information, and a statement made under penalty of perjury that the claim is accurate.

6. Disclaimer of Warranties and Limitation of Liability

"AS IS" Disclaimer: C-13 Digest provides a venue for industry news, business directories, and classified ads. The platform and its content are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including fitness for a particular purpose or non-infringement.

Limitation of Liability: We are not responsible for the accuracy, legality, safety, or reliability of any user-posted classified ads or business listings. Ad responses are not stored in our database and are routed directly to the poster via email. All agreements made between users are strictly between the involved parties. To the maximum extent permitted by law, C-13 Digest’s total cumulative liability to you for any claims arising out of these Terms or your use of the site shall not exceed the amount you paid to C-13 Digest in the twelve (12) months preceding the claim.

 

7. Indemnification

You agree to indemnify, defend, and hold harmless C-13 Digest, its owners, affiliates, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the platform, your violation of these Terms, or any user-generated content you submit, including classified ads, business listings, and reviews.

 

8. Dispute Resolution and Governing Law

  • Governing Law: These Terms of Service are governed entirely by the laws of the State of California, without regard to its conflict of law provisions.
  • Arbitration and Class-Action Waiver: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site shall be resolved by binding arbitration conducted in California, rather than in court. You and C-13 Digest agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

 

9. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the platform prior to the changes taking effect. Your continued use of C-13 Digest after the effective date of the revised Terms constitutes your acceptance of the changes.

 

10. General Provisions

  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and C-13 Digest regarding your use of the platform, superseding any prior agreements or understandings.
